Romania: the law for communication data retention is applicable starting tomorrow

author: www-data

As we all know, the European Union has imposed the communication data retention law, that is all meta-data concerning communication (but not content) must be stored for at least 6 months.

The corresponding national implementation of the law, Law nr. 298/2008 is applicable starting tomorrow, 20th January 2009 in Romania. Full text of the law here and on various blogs, like here and here. For some more digest of the news, try a google search -- should give you enough hits to read for a while...

The law states that the saved information can only be retrieved after legal prosecution has been started against an idividual, unless (and, as always, that's the catch :-) circumstances can be argued by the state attorney to require immediate access to the data. We all know that such circumstances can always be argued to exist...

I wish I could say it's a sad day for mankind, Europe, Romania yadda yadda yadda. But it isn't. Let's face it, the decision was already made several years ago by the EU. That was a sad day. What now is happening is just the logical consequence of implementing an EU directive into national law... so move along, nothing to see here. Go call a friend, watch some TV, or go out on the streets and set state property on fire... whatever. Just don't act surprized, my dear fellow europeans (and romanians, for that matter), we had it coming for quite a while now :-p

Oh, and I almost forgot: the corresponding law has been voted unconstitutional in Bulgary. Let me translate that for Germany, Great Britain, France and other european powers, that once were looked up to as the prototypes of democracy and freedom: "In your face! Former eastern block country could, and you couldn't...HAAAHA!" Same goes to Romania, but at least nobody expected any better from romanian politicians...
